SCO Targets Torvalds, OSDL With Subpoenas In Case Against IBM

Linux Open Source

On Wednesday, the Beaverton, Ore.-based Linux organization and its newly appointed fellow, Torvalds, received subpoenas from attorneys for The SCO Group regarding the company's pending litigation with IBM.

According to a statement issued on Friday by the OSDL, SCO requested that the organization and Torvalds release documents to be used in SCO's legal case against IBM, which was filed last spring.

SCO claims that IBM violated its Unix contract with SCO by improperly donating Unix code to the Linux kernel. Torvalds is the chief developer of the Linux kernel.

The OSDL said it will pay for Torvalds' legal representation. The organization is represented by AterWynne LLP, also of Portland.
